Frequently asked questions
Performance improvement plans (also called "PIPs") are supposed to be used as a way to guide employees who are performing below expectations to improve the quality, efficiency and effectiveness of their work. However, PIPs are sometimes abused as a way of short-cutting a path to termination. Is your PIP legitimate or retaliatory? It's hard to know without talking to you. A retaliatory PIP can be countered with careful rebuttal and/or possibly an internal complaint, best handled by an attorney --or coaching by one, at least.
This is a pretty common scenario, where an employee endures some type of harassment, doesn't complain when he/she/they have the chance, and are then laid off due to reorganization or reduction in force (RIF). You don't lose your right to sue just because you've been laid off or terminated. Let's talk.
